Terms and conditions for using the Snapper application and website.

Welcome to Snapper. These Terms of Service ("Terms") govern your access to and use of the Snapper macOS application ("Snapper" or the "Software") and the accompanying website, provided by Thomas Agius ("we", "us", or "our").

By installing, downloading, accessing, or using Snapper, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Software.

1. Software License

Subject to your compliance with these Terms and payment of any applicable license fees, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the Software on a macOS device that you own or control.

  • You may not decompile, reverse engineer, disassemble, or attempt to derive the source code of the Software, except as permitted by applicable law.
  • You may not lease, rent, lend, sell, redistribute, or sublicense the Software.
  • You may transfer your license to another machine only in accordance with our licensing system and transfer guidelines.

2. Licensing & Registration

To unlock full features, Snapper requires a valid license key. During activation, the Software transmits your license key and a cryptographically hashed Hardware UUID to verify your purchase. You agree to provide accurate email details at the time of purchase and keep your license key confidential.

3. Third-Party Integrations

Snapper provides integrations with third-party platforms to enhance your screenshot sharing workflow:

Google Drive Integration

If you enable Google Drive uploads, the Software accesses your Google Drive using the drive.file OAuth scope. Your use of this feature is subject to the Google Terms of Service and Google Privacy Policy. Snapper only interacts with files that are explicitly created or uploaded by the Snapper app.

ImgBB Integration

If you upload screenshots to ImgBB, your uploads are subject to ImgBB's terms of service and privacy settings. We are not responsible for the availability, content, or policies of ImgBB.

We are not responsible for any services, content, or practices of third-party providers. Your interactions with third-party services are solely between you and the third party.

4. User Content & Intellectual Property

You retain ownership of any screenshots, text, and markings you create using Snapper. We do not store, copy, or monitor your screenshots or screen content. All content is processed locally on your device.

All intellectual property rights in the Software, website, and design assets belong exclusively to Thomas Agius.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, OR FREE OF ERRORS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THOMAS AGIUS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be subject to the exclusive jurisdiction of the courts of Malta.
